3. Order Placement and Confirmation

A legally binding contract for the sale of the Products is formed only when we send you a Shipping Confirmation notice via email, confirming that the Products have been dispatched. Prior to this confirmation, we retain the right to decline the order.

3.3 Order Modification and Cancellation by Customer

Once an order is submitted, modifications or cancellations are only possible within a very short window (usually less than 1 hour) before processing begins. We cannot guarantee that modifications or cancellations will be possible once the order enters the fulfillment pipeline.

5. Delivery and Shipping Terms

5.1 Shipping Origin and Carrier

5.2 Delivery Times

Estimated delivery times provided on the Website or during checkout are estimates only and are not guaranteed. We are not liable for delays caused by customs processing or postal/courier service issues.

5.3 Risk of Loss and Title

Risk of loss and title for the Products pass to you upon our delivery to the designated carrier. If a shipment is lost in transit, you must notify us within seven (7) business days of the estimated delivery date to initiate a trace or claim process.

5.4 Address Accuracy

The Customer is solely responsible for providing a complete and accurate delivery address. If an order is returned to the sender due to an incorrect or incomplete address provided by the Customer, the Customer may be responsible for the cost of redelivery or the cost of the Products may be refunded, less shipping and handling charges, at the Company's discretion.

6. Returns, Exchanges, and Refunds

6.2 Exceptions

  3. Non-Delivery: If the tracking confirms non-delivery after a reasonable extended period (usually 30 days past the estimated delivery window), we will initiate a refund or reshipment, at our sole discretion.

Approved refunds will be processed back to the original method of payment within 7–14 business days after the issue is resolved and verified. Shipping costs are non-refundable unless the return is due to our error (e.g., wrong item shipped).

IN NO EVENT SHALL CAFSA.BIZ, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE WEBSITE; (II) ANY PRODUCTS PURCHASED OR OBTAINED; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (IV) ANY OTHER MATTER RELATING TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PURCHASE OF PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM, OR $100.00 USD, WHICHEVER IS LESSER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Cafsat.biz and its affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising out of your (a) breach of these Terms, (b) use of the Website, or (c) violation of any applicable laws or regulations in connection with the purchase or use of the Products.

10. Force Majeure

Cafsat.biz shall not be held liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for failure or delay in fulfilling or performing any term when such failure or delay is caused by or results from causes beyond our reasonable control, including, but not limited to fire, floods, embargoes, war, acts of terrorism, insurrection, riots, strikes, lockouts, acts of God, or acts, omissions or delays in acting by any governmental authority, including customs or quarantine officials.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction under which Cafsat.biz operates, without regard to its conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

In the event of any dispute arising out of or relating to these Terms, the parties shall first attempt in good faith to negotiate a resolution. If negotiation fails, the parties agree to submit to non-binding mediation in the jurisdiction governing these Terms.

Upon termination, your right to use the Service will immediately cease. If you have any outstanding orders, the terms regarding delivery and liability will survive termination.
